Summer App Terms of Service

1. Acceptance of Terms

Welcome to Summer App, a web ticketing platform on the cloud created by WS Interactive Web Agency. By accessing or using our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please refrain from using Summer App. These Terms apply to all users of the platform.

2. Description of Service

Summer App is an online platform designed for managing support tickets and customer communication for agencies and web/app professionals. We provide a variety of tools that help improve collaboration and efficiency. Your use of the platform is subject to these Terms, and you agree to use Summer App only as permitted by law and these Terms.

3. Registration and Account Security

To access the full features of Summer App, you must register for an account. By registering, you agree to:

• Provide accurate, current, and complete information.
• Keep your account credentials confidential.
• Notify us immediately of unauthorized use or suspected breaches of security.

Summer App is not liable for losses caused by unauthorized use of your account.

4. Payment, Billing, and Cancelation

Certain features of Summer App require payment. By selecting a paid plan, you agree to pay the subscription fees associated with your chosen plan. All payments are non-refundable unless stated otherwise. We reserve the right to change pricing, but we will provide notice in advance.

Monthly Subscriptions

• Customers paying monthly can cancel anytime by providing notice at least 1 day before the renewal date.
• After cancellation, accounts are downgraded to the Start Plan (free, includes 2 users, 2 GB of storage, and 2 active projects).
• Customers cannot downgrade until they remove extra users, storage, and projects exceeding the limits of the Start Plan.
• Customers may upgrade to a yearly subscription at any time. The yearly price will be calculated on a pro-rata basis for the remaining monthly subscription period. The new subscription will take effect immediately.

Yearly Subscriptions

• Customers paying annually benefit from a discount and must cancel their subscription at least 1 day before the renewal date to avoid automatic renewal.
• Customers may change to a monthly subscription at any time, but the change will only take effect after the yearly subscription period ends.
• After cancellation, accounts are downgraded to the Start Plan (free, includes 2 users, 2 GB of storage, and 2 active projects).
• Customers cannot downgrade until they remove extra users, storage, and projects exceeding the limits of the Start Plan.

Account Deletion

Customers may opt to delete their account entirely. Account deletion will result in:

• Immediate removal of all data, projects, and account access.
• No backups are available after account deletion.

Adding Users, Storage, or Projects

When customers add new users, increase storage capacity, or add projects, the associated charges are calculated immediately and paid pro-rata for the remainder of the current subscription period.

Deleting Users, Storage, or Projects

When customers reduce the number of users, storage, or projects below their paid subscription level, a credit will be issued for the unused portion. The credit will automatically apply to the next subscription renewal.

Payment

All payments are made to WS Interactive, SA, located in Toulouse, France. 

5. User Content and Conduct

You retain ownership of all content you upload to Summer App. However, by using the platform, you grant us a non-exclusive license to use your content solely for operating and improving our services. You are responsible for the legality, reliability, and appropriateness of your content. Prohibited activities include:

• Using Summer App for unlawful purposes.
• Uploading malicious code or engaging in activities that harm our platform.
• Violating intellectual property rights.

6. Intellectual Property Rights

Summer App and its original content, features, and functionality are owned by us and are protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without prior written consent.

7. Data Protection and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data. By using Summer App, you agree to our data practices as described in the Privacy Policy.

8. Service Availability and Updates

We strive to ensure Summer App is available 24/7. However, we do not guarantee uninterrupted service and may experience downtime for maintenance or technical issues. We also reserve the right to modify or discontinue any feature without notice.

9. Termination of Use

We reserve the right to suspend or terminate your access to Summer App at our sole discretion, without notice, if you violate these Terms. Upon termination, your right to use the platform ceases immediately.

10. Limitation of Liability

To the fullest extent permitted by law, Summer App is not liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the platform.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Toulouse, France. Any disputes arising under these Terms shall be resolved in the courts of Toulouse, France.

12. Changes to Terms

We may revise these Terms from time to time. We will notify you of significant changes by posting an update on our platform or contacting you directly. Your continued use of Summer App after such changes indicates your acceptance of the new Terms.

13. Restricted Sales

We do not sell to customers in embargoed or sanctioned countries.

14. Language Precedence

In case of conflicts between the English and other language versions of these terms, the English version shall prevail.
